What I could see a problem with is to decide how much the "mood" of a picture influences whether you count it as "explicit" rather than a strictly factual check of "do we see uncovered genitalia?"
I think that this is why the policy asks people just to use their best judgment, to be honest. Contributors will have to decide for themselves on a case-by-case basis, although I think that sexual activity is the key test. And bear in mind that the committee won't police this (or even know how an image was categorized) unless another user complains, most likely.
Re your question about plain full nudity, I think that this falls into the area of NSFW, and I liked your earlier suggestion about asking article editors just to include a note warning for NSFW at the top of the article.
